1. About these terms

These Terms of Service (“Terms”) govern your use of MTDFile, an online tax filing service that submits Income Tax (ITSA) and VAT returns to HMRC on your behalf. By creating an account or using the service, you agree to these Terms.

MTDFile is operated from the United Kingdom. These Terms are governed by the laws of England and Wales.

2. Service description

MTDFile provides:

• Quarterly Income Tax Self Assessment (ITSA) filing to HMRC via the Making Tax Digital API.
• VAT return preparation and submission to HMRC via the MTD for VAT API.
• A dashboard to review obligations, track submissions, and manage your tax data.

MTDFile is connects directly to the HMRC MTD API software. We act as a conduit between you and HMRC — we transmit the data you provide.

MTDFile is not affiliated with, endorsed by, or operated by HM Revenue & Customs. “Making Tax Digital” is a UK government programme. We use HMRC's public APIs to submit returns on your behalf, but HMRC is responsible for processing those submissions.

If HMRC's API is unavailable, experiences downtime, or rejects a submission, MTDFile is not liable for any resulting late-filing penalties. We will notify you of any failed submissions and allow you to retry.

5. Your responsibilities

• You must provide accurate, complete, and truthful information when filing returns.
• You are responsible for meeting all HMRC deadlines. MTDFile will display your obligations but filing on time is your responsibility.
• You must keep your account credentials secure and not share them with unauthorised persons.
• You must not use the service for any unlawful purpose, including tax fraud or evasion.

6. Pricing and payment

• MTDFile offers monthly subscription plans. Current pricing is displayed on our pricing page.
• All prices are in GBP and include VAT where applicable.
• Payments are processed securely by Stripe. We do not store your card details.
• Your subscription renews automatically each month. You can cancel at any time from your account settings.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.

7. Cancellation and refunds

• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
• You will retain access to the service until the end of the period you have already paid for.
• Refunds are provided at our discretion. If you cancel within 14 days of your first subscription payment and have not submitted any returns to HMRC, you are entitled to a full refund under UK consumer law.
• After a return has been submitted to HMRC, that filing cannot be “undone” and no refund will be issued for the period in which the submission was made.

8. Limitation of liability

To the fullest extent permitted by law:

• MTDFile is provided “as is”. We do not guarantee uninterrupted or error-free service.
• We are not liable for any indirect, incidental, or consequential damages, including lost profits, penalties, or fines imposed by HMRC.
• Our total liability for any claim arising from the service is limited to the amount you have paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Data accuracy

MTDFile transmits your data to HMRC exactly as you enter it. We perform basic validation (e.g. checking required fields) but we do not audit or verify the accuracy of your figures. You are legally responsible for the content of your tax returns.

10. Intellectual property

All content, code, designs, and trademarks within MTDFile are owned by MTDFile. You may not copy, modify, distribute, or reverse-engineer any part of the service without prior written permission.

11. Account termination

We reserve the right to suspend or terminate your account if you breach these Terms, use the service fraudulently, or fail to pay your subscription. We will provide reasonable notice where possible.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.
